Excellent Program to Help Prevent Denver area Car Accidents

Morgan County residents and police have noticed a higher incidence of auto accidents and traffic tickets among African refugees who do not have experience in using cars to get around. To help alleviate the problem, rRefugees and others in Morgan County will be able to take a class to help them understand the rules of the road and learn how to drive cars more safely starting March 22nd.
The first sets of classes, to be conducted March 22-27, are available in two sessions for the convenience of those who are taking the class. There are Monday through Friday from 9 a.m. to noon and 5:30 to 8:30 p.m sessions. Both sessions will be at Morgan Community College, 920 Barlow Road, in Cedar Hall, in the the adult basic education building.
Prospective students can sign up at Cedar Hall.
Morgan County officials coordinated with representatives of Lutheran Family Services, which helps refugees get started in their new country, and the Colorado Refugee Services Program to come up with the idea of teaching the African refugees how to understand driving.
This has led to the creation of the class in English as a second language for driver education, where the goal is to improve the vocabulary associated with driving, including understanding the meaning of traffic signs and road markings.
The language barrier is not the only reason why some refugees may have difficulties on the road, the other part is cultural. Most USA children grow up watching their parents drive, but many of the refugees have never had a chance to drive and rarely even ride in vehicles.
Following the driving language class, the refugees will be eligible for $200-$300 scholarships to go to a Brush driving school for on-the-road experience
The CRSP has agreed to fund the program, which is the first of its kind in Colorado.
These classes are not just for refugees. Others who struggle with English can take the classes, but the scholarships for on-the-road training are for refugees exclusively.
Students will also learn what to do if they are pulled over by an officer and common phrases an officer might use, Zion said.

Georgia head car accident with pickup truck

A United States Marine, was killed in a head-on collision with a pick-up truck. He had just returned from Iraq and was on his way home with his wife.
His wife survived the crash but sustained critical injuries.
Charges are expected to be filed against the driver of the pickup truck due to the fact that he was allegedly driving the wrong way on the wrong side of the road, causing the tragic head-on collision Saturday, March 13, 2010. The U.S. Marine was only 21 years old, and was returning home from a tour of duty in Iraq when the crash occurred. The Marine was fatally injured while his wife was in critical condition after the accident.

Emergency medical services (EMS) personnel responded to the scene of the car accident to transport those injured in the wreck to area hospitals to be treated by doctors and nurses. The marine, Gregory Suedmeyer, was pronounced dead at Grady Memorial Hospital about two hours after the accident. His wife, Katelyn Suedmeyer, 19, was flown to Atlanta Medical Center via medical helicopter where she was in critical but stable condition. The driver of the pickup triuck, Joseph Quayle, 71, was transported to Grady Memorial Hospital where he remains in stable condition. There was also a dog in the Suedmeyer’s car when it crashed, the dog suffered fatal injuries as well.

Federal and Postal Disability Retirement under FERS & CSRS: The Tyranny of Logic

The general concept of 'tyranny' is normally reserved for extreme cases of autocratic emblems of dictatorships, governmental overreaching, denial of due process, etc., and is rarely used in addressing issues arising in Federal Disability Retirement laws governing Federal and Postal workers who are attempting to access an employment benefit which is part of the Federal and Postal employment package -- that of Federal Disability Retirement benefits under FERS or CSRS. In this use of the term, however, it is in conjoining two independent concepts: that of 'tyranny' and that of 'logic'. The compounding of the terms results in a concept which is applicable in a positive sense. Allow me to explain. In the course of filing for Federal or Postal disability retirement benefits, when one is denied at any level of the administrative process, one has a right to a further appeal. Thus, if the application for Federal Disability Retirement benefits is denied at the First Stage of the process, then you have a right to have it 'reconsidered' (called the "Reconsideration Stage", appropriately). If it is denied a second time, you then have the right to file an appeal to the Merit Systems Protection Board -- and beyond. At each stage of the process, one hopes that in the review and evaluation of the Federal Disability Retirement application, first by the Office of Personnel Management, then by an Administrative Judge, then by a Federal Appellate Judge, that a set of legal criteria is fairly and uniformly applied, such that the 'tyranny of logic' rules. In this sense, 'tyranny' is meant to apply in a positive sense, in that a logical, fair and uniform application of the law is applied to the set of facts presented by the Federal or Postal disability retirement application. This all assumes, of course, that somewhere along the line of the 'food-chain' of review, that someone has been exposed to either logic, logical argumentation, or the 'rules of logic'. When it comes to tax deductions, nearly every penny counts. Given the economic situation and persistent unemployment, a relatively large number of people work at home and meet their clients or customers outside their homes. These people would be happy to hear, they are the best candidates to deduct their commuting expenses between home and work.

PRINCIPAL PLACE OF BUSINESS

Unfortunately, people who work outside their homes - generally - cannot deduct commuting expenses. To be able to deduct commuting expenses, your home office MUST QUALIFY as your principal place of business.

1. Definition of Principal Place of Business

Home Office Used Regularly and Exclusively for Your Business: This requirement means your home office was used as the only place for MOST of income-earning activities in the past year. This exclusive use MUST also be regular. Generally, you cannot have used your home office once a week or a month for income-earning activities, although there could be exceptions.
Alternatively, Home Office Used Exclusively and Regularly for Management and Administrative Functions: This means you did not use anywhere else for doing management and administrative functions on a regular basis in the past year. However, you could have used another office only for meeting your clients while doing all the management and administrative functions at your home office.
Examples of Management and Administrative Functions: Examples of management and administrative functions could be: Preparing client Proposals and Invoices, Strategic Planning, Market Research, Keeping Yourself Abreast of Professional Literature and etc.

EXAMPLES OF DEDUCTIBLE COMMUTING EXPENSES

1. Deductions between Home Office and Another Office for Only Meeting Clients: Let us say you have another office somewhere else that you use for only meeting clients but you do all your research, preparation and planning at your home office regularly and exclusively. Then, you are entitled to deducting all your commuting costs between your home office and the other office you use for just meeting clients. For mileage rates in 2009 and 2010, Click Here.

2. Deductions between Home Office and Bank, Post Office, Office Supply Store, Starbucks to Meet Your Clients: You can also deduct all the commuting costs you incur as a result of going to the bank to deposit your client check or withdraw money for your business, when you go to the post office to send out your business mail or when you go to purchase office supply.

3. Deductions Whether You Drive or Take a Cab or Use Public Transportation: No matter how you commute, you can deduct all the applicable expenses including the standard business mileage allowance.

Well before the digital age, we heard the expression, “a picture is worth a thousand words.” Nowhere is that more appropriate than in the personal injury context. In any kind of medical testimony, the doctor, who in effect is a teacher, should use demonstrative aids to explain his/her testimony. Not only does it make the testimony more interesting, it is far easier to explain the anatomy when pointing to the appropriate exhibit rather than speaking in the abstract.

This applies to in-court testimony as well as to depositions to be used at trial. Moreover, demonstrative aids should be used not only in court but for any form of alternative dispute resolution, such as arbitration or mediation.

Exhibits and aids have their place as part of the liability case. Just as they inform a mediator or trier-of-fact about the anatomy, they can provide essential information about an accident scene, a product, or a premises. They are teaching tools and, when properly employed, help to convey your injury lawyer’s approach to the case.

That brings up the other component of an accident case. You must
have sustained damages in order to receive compensation. “Damages” is
the legal term used to describe injuries. Damages can be economic or
non-economic. Economic injuries are things such as medical bills,
property damage and lost wages, while non-economic damages are things
like emotional stress and pain and suffering. The type and extent of
your injuries will have some bearing on the amount of compensation that

Divorce Statistics for Florida

According to the Vital Statistics Annual Report issued by the Florida Office of Vital Statistics, there were 84,386 dissolutions in Florida in 2007. Dissolutions include divorces and annulments.

The mean duration of a marriage resulting in a 2007 dissolution was 10.2 years. Here is a breakdown of the number of dissolutions and the duration of the marriage:

The report found that 56.2% of the dissolutions in 2007 did not affect minor children. Here is a breakdown of the number of dissolutions and the number of minor children affected:

About 16% of all dissolutions occurred in Miami-Dade County. About 46% of all dissolutions occurred in the top five counties for dissolutions:

The report reveals that historically the dissolution rate per 1,000 population in Florida is higher than the U.S. rate. In 2007, the dissolution rate per 1,000 population in Florida was 4.5, while the U.S. rate was only 3.6.

The Florida dissolution rates per 1,000 population grew every ten years until 1990, when they started to decrease:

A bit of good news coming out of the report from the Office of Vital Statistics? The 2007 marriage rate of 8.3 per 1,000 population was more than 1.8 times the 2007 dissolution rate of 4.5 per 1,000 population.

The Civil Justice System and Crime Victim-Survivors

I received three calls this week regarding three separate criminal court cases that ended with the Defendant being found not guilty, and which involved allegations of sexual abuse.

In each of them, the caller had questions about how things could go this way or that way at trial. In each of the calls, I said I could not comment on it, because I wasn't there to see the trial and I didn't know what rulings were made throughout the course of the trial that would have caused one thing to happen or prevent another thing from happening.

What I do know is that we have two separate systems of justice: the civil justice system and the criminal justice system. In the sexual abuse area, one focuses on the State's goal to prosecute an alleged perpetrator. The other focuses on the legal rights and the ability for the victim-survivor to obtain relief through damages. The civil justice system is victim/survivor-focused. Further, the person bringing such a claim in the civil system of justice has the ability to make all of the decisions about how to proceed, whether the case should go forward, and also when to stop the proceedings.

Many times, a criminal case cannot be proven beyond a reasonable doubt, a higher standard than the civil "preponderance of the evidence" standard. There are other considerations that arise when people explore whether the civil justice system can adequately protect their legal rights.

NEW BILL IN OHIO LEGISLATURE AIMS TO CLOSE LOOPHOLES IN SEX OFFENDER LAW

Criminal lawyers from the Robey & Robey law talk about the new bill by State Senator Shirley Smith and how it affects the practice of sex crime law in Ohio.

State Senator Shirley Smith has introduced a new bill that is designed to close two loopholes in Ohio's current sex offender registration law. The proposed changes would require community notification if sex offenders are reclassified. Under current law, there are 3 tiers or classes of sex offenders: Tier I, Tier II and Tier III. The offenders in these categories are required to register with law enforcement for periods of 15 years, 25 years or lifetime. This new bill comes in the wake of multiple murder charges pending against convicted Cleveland sex offender Anthony Sowell.

There can be no doubt that having to register as a sex offender is a badge that no person wants to have. However, in Ohio, as in most states, if a person is convicted of a sex offense, registration is mandatory. The only real way to avoid this badge is to fight the charges at trial and be acquitted.
